RESOLUTION AUTHORIZING THE INGHAM COUNTY DRAIN COMMISSIONER AND INGHAM COUNTY HEALTH DEPARTMENT TO COMPLETE PHASE 1 OF A CLOSURE PLAN FOR ARSENIC SEDIMENT SPOIL SITES AT LAKE LANSING

RESOLUTION #00-211

WHEREAS, Lake Lansing is an important water resource in Ingham County, providing recreational, economic, and environmental benefits to the County; and

WHEREAS, Ingham County, along with local, state, and federal governments and district property owners have invested in improvements to Lake Lansing to ensure that the lake remains a quality water resource for the citizens of the county; and

WHEREAS, in 1957, arsenic compounds were applied to Lake Lansing as a treatment for weeds, and in 1976 the Board of Public Works was authorized to dredge the lake; and

WHEREAS, the spoils from the dredging were placed on three county owned sites near Lake Lansing and all sites showed elevated arsenic levels within the first year of deposit, thereby necessitating the county= s responsibility for implementing a spoil site closure plan; and

WHEREAS, the State of Michigan listed Lake Lansing sediment as a site of environmental contamination under Act 307 in 1985 based on the evidence that the level of arsenic in the sediment was above background level and that the arsenic was a result of human activity; and

WHEREAS, the Michigan Department of Environmental Quality has sent a letter to the Ingham County Drain Commissioner ordering Ingham County= s closure plan for the spoil sites, which will bring these sites to a state where they are no longer a possible threat to people or the environment; and

WHEREAS, the first phase in complying with the closure order is to assemble spoil site history, environmental assessment records, and identify contaminants or issues of concern, and in addition to reviewing existing data, samples of the spoils material and of the shallow groundwater will be collected and analyzed to determine if the arsenic levels have increased, stayed the same or have gone down; and

WHEREAS, results from the data collected from Phase 1 will assist in determining what other information or action is necessary to comply with the order and this phase can be completed using county personnel within the Drain Commissioner= s office and the Health department.

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorizes the Ingham County Drain Commissioner and the Ingham County Health Department to proceed with Phase 1 of a closure plan for the Lake Lansing arsenic sediment spoil sites.

BE IT FURTHER RESOLVED, that $15,000 be appropriated from contingency funds to cover related costs of sampling, testing, and relevant expenditures not to exceed the appropriated amount.
