RESOLUTION AUTHORIZING A COST SHARING AGREEMENT WITH U.S. ARMY CORPS OF ENGINEERS FOR OBTAINING DIGITAL ORTHOPHOTOGRAPHS OF INGHAM COUNTY AND AUTHORIZING COST SHARING AGREEMENTS WITH MUNICIPALITIES



RESOLUTION #03-72



WHEREAS, the Drain Commissioner believes that having digital orthophotographs of the entire county will be of great benefit to all municipalities, including the County, and will complement many functions, including land use planning, mapping, and tax mapping; and



WHEREAS, the Drain Commissioner wishes to have the mapping necessary to develop a comprehensive plan to manage the utilization and conservation of water and related land uses; and needs the digital orthophotographs and related information in order to do so; and



WHEREAS, the Drain Commissioner is proposing that the Ingham County Board of Commissioners approve a 50%-50% cost sharing agreement with the U.S. Army Corps of Engineers to obtain the digital orthophotographs and related information; and



WHEREAS, the total initial estimated cost of the proposed work is $560,000, but a potential change in specifications is being considered which may increase the total estimated cost to $700,000; and



WHEREAS, the County would be required to pay 50% of the total cost; and



WHEREAS, while funds have not been budgeted for this agreement, the Drain Commissioner is proposing that the funds will be repaid by municipalities within the County; and



WHEREAS, no formal commitments by municipalities have been received as of this date.



THEREFORE BE IT RESOLVED, that the Board of Commissioners approves a 50%-50% cost sharing agreement with the U.S. Army Corps of Engineers for the purpose of obtaining digital orthophotographs of the entire County, and other information as specified in the proposal submitted by the U.S. Corps of Engineers, at a total cost not exceeding $700,000.



BE IT FURTHER RESOLVED, that approval of such agreement is contingent upon certification by the Controller that some or all of the municipalities within the County, or other public agencies, agreeing to reimbursing the County for all costs, and to holding the County harmless for any and all liabilities associated with the product, the delivery of the product, or the purposes for which the product is used.



BE IT FURTHER RESOLVED, that copies of the digital orthophotographs, maps, and other information received pursuant to this agreement, in hard copy and/or digital form, shall be provided at no additional cost to each municipality within the County who financially supports this project, and at no cost to any office or agency of the County requesting same.

BE IT FURTHER RESOLVED, that the Board authorizes the funds to be advanced from the General Fund and repaid within a period that is acceptable to the Controller.



BE IT FURTHER RESOLVED, that the Drain Commissioner is authorized to approve changes to the specifications proposed by the Corps of Engineers as deemed necessary to obtain the best product.



BE IT FURTHER RESOLVED, that the agreement between the County and the participating municipalities will specify that each will, upon request, provide each other in a compatible format, any information generated as a result of receiving the information provided by the U.S. Army Corps of Engineers.



BE IT FURTHER RESOLVED, that the Board authorizes the Board Chair and County Clerk to sign necessary agreements with the U.S. Army Corps of Engineers and individual municipalities, as approved as to form by the County Attorney.
