RESOLUTION AUTHORIZING ENTERING INTO CONTRACTS WITH LEDY DESIGN GROUP AND SPICER GROUP FOR ENGINEERING SERVICES AT THE DRAIN COMMISSIONER'S OFFICE



RESOLUTION #01-249



WHEREAS, the position of Engineer in the Drain Commissioner's Office is vacant; and



WHEREAS, there are ongoing obligations of the Drain Commissioner's Office to be met; and



WHEREAS, Ledy Design Group and Spicer Group have proposed to provide these services on an interim basis; and



WHEREAS, the Board of Commissioners approved Resolution #01-215, which authorizes a contract with Fitzgerald, Henne & Associates, Inc. on an interim basis, based on the proposal submitted; and



WHEREAS, there are engineering services which would be included in the Fitzgerald Henne contract but for Fitzgerald Henne's conflict of interest caused by its work as an engineer for private entities having business with the Drain Office; and



WHEREAS, the Drain Commissioner has found two other firms, Ledy Design Group and Spicer Group, willing to perform needed engineering services on the same basis as that agreed to by Fitzgerald Henne.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorizes contracts with Ledy Design Group and Spicer Group for engineering services, for a period of six months beginning August 13, 2001 with a six month extension.



BE IT FURTHER RESOLVED, that the Scope of Services to perform include:



� Provide engineering reviews and engineering inspections for commercial and other developments as assigned by the Drain Commissioner or his designated representative.



� Provide soil erosion and sedimentation control reviews and inspections for commercial and residential projects as assigned by the Drain Commissioner or designated representative in preparation for issuance of soil erosion permits by the Drain Commissioner's Office. Such reviews will be performed by a Licensed Professional Engineer with a soil erosion certification.



� Meet with developers of sites required to be inspected by the Drain Commissioner or his designated representative and respond to questions.



� Perform site visits as needed.



� Respond to constituent questions on sites reviewed by the Contractor.

� Provide Drain Commissioner or designated representative with documentation outlining review comments of sites reviewed.



� Meet with Drain Commissioner or designated representative as necessary to discuss issues arising out of services provided under this Agreement including, but not limited to, review and consultation regarding a development's legal agreements with the Drain Commissioner's Office for maintenance, expansion of drainage districts, or acceptance of drainage systems.



Services performed under this Agreement shall be provided by Licensed Professional Engineers.



� Maintain records of documents reviewed and provide such documentation to the Drain Commissioner upon end of project or termination of this Agreement, whichever comes first.



BE IT FURTHER RESOLVED, that the Contractors shall be compensated in accordance with the Ingham County Soil Erosion and Sedimentation Control Program Fee Schedule adopted July 1, 1998 and amended January 23, 2001; and further that any services performed that are not included in the Fee Schedule, including but not limited to consultation on residential soil erosion permits and drain maintenance, shall be compensated at a rate of SIXTY-FIVE AND NO/100 DOLLARS ($65.00) per hour.



BE IT FURTHER RESOLVED, that the Controller is authorized to make the necessary adjustments within the Drain Commissioner's budget.



BE IT FURTHER RESOLVED, that the Board Chairperson and County Clerk are authorized to sign the contracts upon the approval of the County Controller and as approved to form by the

County Attorney.
