RESOLUTION AUTHORIZING ENTERING INTO A CONTRACT WITH HLH TOWERS, LLC FOR THE PURPOSE OF LEASING PROPERTY AT THE INGHAM COUNTY CORRECTIONAL FACILITY IN ORDER TO REMOVE AND TO CONSTRUCT A NEW COMMUNICATIONS TOWER



RESOLUTION #01-271



WHEREAS, the Ingham County Correctional Facility has a communications tower that holds public safety and governmental communications needs; and



WHEREAS, the current communications tower is over 30 years old and needs to be replaced; and



WHEREAS, the County of Ingham is interested in revenue sharing, produced from the commercial development of the communication tower facility; and

WHEREAS, the Purchasing Department solicited formal Request for Proposals for the removal and construction of a communications tower; and after review and evaluation, is recommending that a contract be authorized with HLH Towers, LLC, who proposed the greatest potential revenue for the County.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorize a contract with HLH Towers, LLC for the purpose of leasing a 100' x 100' compound adjacent to the existing communications tower located at the Ingham County Correctional Facility for the construction of a new 300' self support lattice tower and equipment shelter.



BE IT FURTHER RESOLVED, that at no time during the construction of the communications tower shall there be any interruptions in the County's current public communications systems, and that once the new tower is constructed, all immediate and future public communications systems of the County shall be placed onto the new communications tower, at the County's discretion.



BE IT FURTHER RESOLVED, that the tenant, HLH Towers, LLC, will maintain the communications tower at no cost to the County over a course of 30 years (an initial contract of 5 years with five 5- year renewals), and will initially pay the County a land rent of $1,000.00 per month or ten per cent (10%) of the gross receipts derived by the lessee from the revenues of this tower whichever is greater, with annual increases in rent of 3% per year.



BE IT FURTHER RESOLVED, that HLH Towers, LLC may, at its discretion, commercially market the remaining tower facility space to meet the needs of non-government radio system operators (such as cellular telephone, PCS, etc.) seeking to expand or offer their services within Ingham County but only to the extent that it does not interfere with the County's needs for the tower facility.



BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners authorize the Board Chairperson and the County Clerk to sign any necessary contract documents for the removal and construction of the communications tower approved as to form by the County Attorney.
