RESOLUTION AUTHORIZING SETTLEMENT OF LITIGATION

AND AUTHORIZING ADDITIONAL SERVICE CREDIT TO ELLIS

BRUMBAUGH, JR.

RESOLUTION #01-296

WHEREAS, in the case of Sheriff Wriggelsworth and Ingham County v Ellis Brumbaugh, proposed settlement has been offered which includes the granting of additional service credits to Ellis Brumbaugh, Jr.; and

WHEREAS, the County Attorney has recommended the proposed settlement.

THEREFORE BE IT RESOLVED, that, as provided by the MERS Plan Document, 6 years and 6 months additional service credit is granted to Ellis Brumbaugh, Jr. at cost and conditions as estimated by the Municipal Employees Retirement System on September 17, 2001, and as provided by the MERS Plan Document and the proposed Settlement Agreement in the captioned matter.

BE IT FURTHER RESOLVED, that as provided in the MERS Plan Document, Ellis Brumbaugh, Jr. is authorized to purchase an additional 4 years and 3 months service credit, at cost and conditions as estimated by the Municipal Employees Retirement System on September 17, 2001, the MERS Plan Document, and as provided in the Settlement Agreement.

BE IT FURTHER RESOLVED, that the County Attorney is authorized to undertake settlement consistent with the terms and conditions of the Settlement Agreement as presented to the Board.

BE IT FURTHER RESOLVED, that the Board Chairperson is authorized to sign the necessary documents to authorize this additional service credit and to accept the proposed settlement as accepted by the County Attorney.
