RESOLUTION AND ORDER OF ANNEXATION OF CERTAIN LAND TO THE
VILLAGE OF WEBBERVILLE
RESOLUTION #01-54
WHEREAS, the Village of Webberville, located in the Township of Leroy , Ingham County, Michigan, has filed petitions with the Ingham County Board of Commissioners for annexation, asking for this Board's approval pursuant to Section 6 of Act 3 of the Public Acts of 1895, as amended, of the annexation of certain land located in the Township of Leroy, Ingham County; and
WHEREAS, a description of said land having been set forth in the petition together with the reasons for the proposed change and a copy of the resolutions of the Webberville Village Council in relation thereto having been included therewith; and
WHEREAS, the petition is at the request of the Village of Webberville and the developers of Fairway Oaks Condominium Project, the owners of the property be annexed; and
WHEREAS, the property owned by the Village of Webberville is used by the Village for public purposes; and
WHEREAS, the property owned by Fairway Oaks Condominium developers needs to be annexed into the Village for the development to comply with site plan conditions and zoning requirements; and
WHEREAS, that the property in question is contiguous to the Village limits; and
WHEREAS, it is desirable that the described property be annexed into the Village of Webberville; and
WHEREAS, this Board having held public hearings, pursuant to notice thereof duly published in the Fowlerville News and Views, on said petition at the County Courthouse Building in the City of Mason during the County Board of Commissioners meeting of January 23, 2001; and
WHEREAS, all interested parties having had an opportunity to be heard by this Board on the subject matter contained in said petition and all requirements of Section 6, Chapter XIV, Act 3, PA 1895, being MCL 74.6; MSA 5.1470, having been met; and
WHEREAS, this Board having determined that said petition should be granted.

IT IS THEREFORE ORDERED AND DETERMINED that the land, more specifically described in Exhibit A, located in the Township of Leroy, County of Ingham, State of Michigan, be annexed to the Village of Webberville and its boundaries shall be so altered.
IT IS FURTHER ORDERED that certified copies of this Order and Determination shall be transmitted to the Village of Webberville and to the Secretary of State for the State of Michigan, and such Order shall be prima facie evidence of such change of boundaries of the Village of Webberville and of the regularity of such proceedings in all courts and places.
