INGHAM COUNTY BOARD OF COMMISSIONERS



RESOLUTION AUTHORIZING ASSISTANCE IN THE RELOCATION OF THE COUNCIL AGAINST DOMESTIC ASSAULT (CADA)



RESOLUTION #98-117



WHEREAS, Ingham County has for many years provided CADA with a building for operation of the women's domestic violence shelter; and



WHEREAS, it may be desirable for the County to sell or trade the building currently used by CADA in order to assist the City of Lansing in its economic development efforts to retain an existing industry in Lansing and in Ingham County; and



WHEREAS, if that occurs then it will be necessary for CADA to be provided with an adequate building in which to continue its activities; and



WHEREAS, the Ingham County Board of Commissioners desires to continue providing CADA with a building as it has in the past;



THEREFORE BE IT RESOLVED, that the Board of Commissioners authorizes the sale of Lesher Place for a price reflective of fair consideration, or the trade of Lesher Place for an alternate facility of comparable value;



BE IT FURTHER RESOLVED, that in the event of a sale, the net proceeds shall be used by the County toward the purchase of a replacement building for CADA, or that in the event of a trade, the building received shall be offered to CADA for lease;



BE IT FURTHER RESOLVED, that in the event that Lesher Place is sold, that the County's assistance in relocating CADA shall be limited only to the use of the net proceeds from the sale towards the purchase of a replacement building, or that in the event of a trade, that the County's assistance in relocating CADA shall be limited to offering CADA the use of the building received in trade, for lease;



BE IT FURTHER RESOLVED, that the County's assistance does not extend to making or appropriating funds for any renovations, additions, modifications, or the physical move to any facility leased to CADA;



BE IT FURTHER RESOLVED, that the County's assistance is contingent upon CADA furnishing an acceptable plan to the County, for accomplishing any needed or desired renovations, additions, or modifications to the replacement building, and a business plan for continuing operation and maintenance of the replacement building;



BE IT FURTHER RESOLVED, that CADA's plan shall include the sources of financial and other resources necessary to implement these plans, such as the City of Lansing;

BE IT FURTHER RESOLVED, that the Controller and County Attorney are authorized to negotiate the terms of the sale or trade of Lesher Place, the purchase of a replacement building, if necessary, and terms of a lease with CADA, consistent with the intent of this resolution;



BE IT FURTHER RESOLVED, that the recommended terms of any sale, trade, lease or purchase consistent with this resolution shall be presented to the Board of Commissioners for its consideration and approval.
