RESOLUTION AUTHORIZING A PURCHASE AGREEMENT TO ACQUIRE NOVELL SOFTWARE THROUGH A NOVELL CORPORATE LEASE AGREEMENT

RESOLUTION #98-120

WHEREAS, the Ingham County Board of Commissioners in 1994 approved the funding for a County Wide Area Network (WAN) and that Network has been implemented based on the Novell Operating System; and

WHEREAS, the Novell Software is constantly being upgraded and additional software is being acquired or developed by Novell as part of the Novell Operating System Software; and

WHEREAS, Ingham County has a need to stay current on the Novell Operating Software versions and has a need to use many of the new products that are acquired and incorporated into the Novell Operating System; and

WHEREAS, a maintenance line item in the Data Processing Fund #636 has been established for the ongoing maintenance of the network, in which funds have been budgeted to cover the cost of such maintenance and upgrade of the network as determined to be essential to its effective and efficient operation; and

WHEREAS, the development and implementation phase of the network project has been completed and the remaining funds have been transferred ($381,231.00) to Fund #636 for continued upgrade and maintenance of the network; and

WHEREAS, Novell has developed a Corporate License Agreement Program to provide an affordable means of acquiring the latest version of the software the County needs to utilize; and

WHEREAS, the Ingham County MIS Director has reviewed this proposal and believes this proposal to be in the best interest of the County.

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorizes a two-year purchase agreement with Ideal Technologies to acquire the Novell Corporate License Agreement at a value of $100,000.00, over a two-year period, which represents a 34% discount on the software and guarantees Ingham County upgrade protection during this period.

BE IT FURTHER RESOLVED, that funds for this agreement will come from budgeted funds available for the ongoing maintenance and upgrade of the network, in the amount of $50,000 each year of the two-year agreement.

BE IT FURTHER RESOLVED, that the Board Chairperson and the County Clerk are authorized to sign the necessary agreements after approved as to form by the County Attorney.
