RESOLUTION TO AMEND RESOLUTION NO. 97-277 AUTHORIZING A CONTRACT FOR SERVICES BETWEEN INGHAM COUNTY AND THE LAKE LANSING PROPERTY OWNERS ASSOCIATION TO MAINTAIN THE WATERSHED MANAGEMENT PLAN FOR LAKE LANSING INCLUDING THE LAKE FRONTAGE OWNED BY INGHAM COUNTY



RESOLUTION #98-203



WHEREAS, Resolution No. 97-277 authorizes a contract with the Lake Lansing Property Owners Association to implement the five year Watershed Management Plan; and



WHEREAS, the Administrative Services/Personnel Committee later authorized the contract to be developed between the county and the Charter Township of Meridian, since the township is managing the special assessment district for the project and has billed the county its pro-rata share for the maintenance of its lake frontage; and



WHEREAS, the county's resolution has conflicting language to that passed in a similar resolution by the township regarding the township's matching financial contribution to the project; and



WHEREAS, this resolution shall serve as the enabling document for the county's agreement and financial participation in the five (5) year Watershed Management Plan for Lake Lansing; and



WHEREAS, under this funding formula the district is expected to generate sufficient annual revenue for the next five years without additional cost to either the county or the township.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners hereby amends its resolution No. 97-277 to authorize a contract with the Charter Township of Meridian instead of the Lake Lansing Property Owners Association to maintain the Watershed Management Plan for Lake Lansing including the lake frontage owned by Ingham County.



BE IT FURTHER RESOLVED, that it is understood that the county's appropriation of up to $5,200 will be matched by the Charter Township of Meridian in an amount equal to 50% of the county's contribution, and the sum total of both appropriations will be deducted from the annual plan of $40,000 with the remainder of the expenses distributed among the remaining property owners in the special assessment district.

BE IT FURTHER RESOLVED, that the County Controller is hereby authorized to make the necessary budget adjustments as required by this resolution, and the board chair is authorized to sign the contract upon review of the County Attorney as to form.
