RESOLUTION AUTHORIZING AMENDMENTS TO THE ORDINANCE ESTABLISHING A HOUSING COMMISSION



RESOLUTION #98-205



WHEREAS, the Ingham County Ordinance establishing the Ingham County Housing Commission, as amended by Resolution #97-76 requires further amendments to ARTICLE II POWERS AND DUTIES to accomplish the following:

1) Expand the definition of persons eligible for housing at the County's facility located at 3882 Dobie Road, Okemos, Michigan.



2) Expand the Housing Commission's authority to include implementation and administration of Community Development Block Grant funds from the Michigan State Housing Development Authority for the purpose of helping low/moderate income homeowners of the County obtain low or no interest home rehabilitation loans.



3) Expand the Housing Commission's authority to administer Section 8 Programs funded by the Department of Housing and Urban Development that will supply vouchers and certificates to low income residents of Ingham County to obtain subsidy for their rent in the private housing sector.



THEREFORE BE IT RESOLVED, that ARTICLE II POWERS AND DUTIES of the Ingham County Housing Commission Ordinance be, and hereby is, amended to read as follows:



ARTICLE II



POWERS AND DUTIES



(a) Pursuant to Michigan Public Act No. 18 of the Extra Session of 1933, as amended, there is hereby created a commission, to be known as the Ingham County Housing Commission, which shall hereinafter be referred to as the "Commission."



(b) The Commission is specifically authorized and directed to convert the old Medical Care Facility, located at 3882 Dobie Road, Okemos, Michigan 48864 (hereinafter referred to as "Facility"), into housing for low income housing for senior citizens (persons over fifty-five (55) years of age) AND DISABLED PERSONS, who are residents of the County, and to thereupon rent the Facility to senior citizen AND DISABLED residents of the County who have insufficient income to otherwise afford adequate housing.

(c) The Commission shall investigate, engage in and be responsible for public housing projects other than that authorized in Section (b) of this Article, situated in the County for County residents who have low to moderate incomes, which are from time to time approved by the Board of Commissioners. The terms "low" to "moderate" incomes shall be construed as having the same definitions as that used by public or private agencies granting or loaning funds to Ingham County for public housing projects, including, but not limited to, United States Housing and Urban Development and Michigan State Housing Development Authority.



(d) WHEN APPROVED BY THE BOARD OF COMMISSIONERS, THE COMMISSION SHALL IMPLEMENT AND ADMINISTER COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS RECEIVED FROM THE MICHIGAN STATE HOUSING DEVELOPMENT AUTHORITY (MSHDA), FOR HELPING LOW/MODERATE INCOME HOMEOWNERS IN INGHAM COUNTY OBTAIN LOW OR NO INTEREST HOME REHABILITATION LOANS.



(e) THE COMMISSION SHALL ADMINISTER SECTION 8 PROGRAMS FUNDED BY THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD), WHICH ARE APPROVED BY THE BOARD OF COMMISSIONERS, THAT SUPPLY VOUCHERS AND CERTIFICATES TO LOW INCOME RESIDENTS OF INGHAM COUNTY TO SUBSIDIZE THEIR RENT FOR HOUSING IN THE PRIVATE HOUSING SECTOR.



(f) The Commission shall have all of the powers, duties, and limitations set out in Michigan Public Act No. 18 of the Extra Session of 1933, as heretofore or hereafter amended, and Michigan Public Act No. 293 of 1937, as heretofore or hereafter amended, and the supplemental powers and duties set out in this Ordinance to accomplish the goals herein. In the exercise of its powers and duties with respect to housing, the Commission shall at all times strictly limit itself to the needs of those families and individuals who are unable to pay for more expensive housing accommodations and for whom there is insufficient adequate housing in Ingham County within an affordable price range.



BE IT FURTHER RESOLVED, that the remainder of the Ingham County Housing Commission Ordinance, as amended, shall remain unchanged.



BE IT FURTHER RESOLVED, that the County Clerk is hereby directed to take all required action to have this Ordinance Amendment published, as required by State statute.



BE IT FURTHER RESOLVED, that this Ordinance Amendment shall become effective on the date in which it is published by the County Clerk as directed above.
