RESOLUTION AUTHORIZING THE INGHAM COUNTY LIBRARY BOARD TO

MAKE A PAYMENT TO CADL FOR CERTAIN SICK LEAVE ACCUMULATION

LIABILITIES & TO OFFER CERTAIN POST RETIREMENT BENEFITS

WHEREAS, the Ingham County Library Board (ICL) has requested approval of the Board of Commissioners to utilize unbudgeted and unreserved fund balance in the Library Fund to pay the Capital Area District Library Board (CADL) the value of 50% of the accumulated but unused sick leave for ICL employees who are assigned to work for CADL in order to provide some sick leave accumulations for those employees; and



WHEREAS, the Ingham County Library Board has also requested approval of the Board of Commissioners to offer those employees of the Ingham County Library on December 31, 1997 who are eligible to retire no later than December 31, 1998, and who retire no later than December 31, 1998, to be provided post retirement health and life insurance benefits such as presently offered county library employees; and



WHEREAS, the Ingham County Library Board has also requested approval of the Board of Commissioners to utilize unbudgeted and unreserved fund balance in the Library Fund to pay employees who have left ICL instead of going to work for CADL the value of 50% of their accumulated but unused sick leave; and



WHEREAS, the County Controller has recommended the payment to CADL and the granting of the requested post retirement health benefits as being in the best interests of the County; and



WHEREAS, the Capital Area District Library Board has agreed to utilize such funds, if received, to provide sick leave accumulations to those employees.



THEREFORE BE IT RESOLVED, that the Board of Commissioners authorizes the Ingham County Library Board to utilize up to $46,000 in unbudgeted and unreserved fund balance plus $39,293 to be received from the Library Cooperative for payment to the Capital Area District Library of 50% of the value of accumulated but unused sick leave for ICL employees who are now assigned to work for CADL, subject to the following conditions:



1) The ICL will pay CADL the value of 50% of the accumulated but unused sick leave for ICL employees who will be working for CADL. This is to be based on the ICL wage scales. However, such payment will be made only if CADL agrees that

neither the County nor the Cooperative will have any further

liability for sick leave payments for the affected employees. In

addition, the payment will be made only to the extent that the

County Library Fund has sufficient unencumbered fund balance

at the end of 1997, as determined by the County Controller.



2) Using their new wage scales, CADL will establish the amount of sick leave to be credited to each new employee who is currently working for ICL and who will be working for CADL. The amount to be credited among these employees will be proportionate to the accumulated amounts on which ICL payment to CADL is based. It will be less than 50%, because of the difference in wage scales between ICL and CADL.



3)The use of sick leave will be governed by CADL in the same manner as sick leave which will be accumulated under CADL's policy.



4) The CADL will reimburse the County for all sick leave paid employees

who are assigned to work for the CADL, whether the sick time is from

these funded accumulations or from subsequently accrued sick leave as

provided in the agreement beteween the County and the CADL.





BE IT FURTHER RESOLVED, that the Board of Commissioners authorizes the Ingham County Library Board to offer the following post retirement health and life insurance benefits to employees of the Ingham County Library as of December 31, 1997:



Employees of the Ingham County Library on December 31, 1997 who are eligible to retire under the Michigan Muncipal Employees Retirement System (at age 60 with a minimum of 10 years of service) no later than December 31, 1998, and who retire no later than December 31, 1998 shall be eligible to receive paid single subscriber health insurance on the same basis as other Ingham County non-union employees retiring in 1998 and $2,000 life insurance in the plan designated by the County now or in the future.



BE IT FURTHER RESOLVED, that the Board of Commissioners does not approve the request of the Library Board to utilize unbudgeted and unreserved fund balance in the Library Fund to pay employees who have left ICL instead of going to work for CADL the value of 50% of their accumulated but unused sick leave.
