RESOLUTION ADOPTING THE REVISED RULES AND REGULATIONS OF THE INGHAM COUNTY FAIRGROUNDS

RESOLUTION #98-227

WHEREAS, the existing rules and regulations which govern the operations of the Ingham County Fairgrounds were adopted in 1984 by Resolution No.84-124; and

WHEREAS, such rules and regulations are in need of revisions in order to reflect current changes which are necessary to assure the most effective and efficient operation of the Fairgrounds, its facilities, and other resources; and

WHEREAS, the Fair Board has reviewed the existing rules and regulations and has identified areas that are in need of update, deletion, additions and other such revisions; and

WHEREAS, these revisions have been reviewed by the County Attorney, and his review has resulted in the final recommendations by the Fair Board that the revisions be adopted by the Board of Commissioners as the final authority for establishing rules and regulations in reference to the management of the interest concerns of the County per MCL 46.11 (q).

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners hereby adopts the updated Rules and Regulations governing the operations of the Ingham County Fairgrounds.

BE IT FURTHER RESOLVED, that the revised regulations as referenced herein shall have immediate effect with the passage of this resolution.

RULES AND REGULATIONS

FOR

INGHAM COUNTY FAIRGROUNDS

The following rules and regulations are made and adopted by the Ingham County Board of Commissioners respecting the use by the public of Ingham County Fairground Property, pursuant to MCL 46.11 and MCL 46.151 and 46.153.

ARTICLE I

Section 1

a. The Fairgrounds shall be open from 8:00 A.M. to 10:00 P.M., unless otherwise determined by the Ingham County Fair Board.

b. Any Fairground land, or portions thereof, may be closed entirely or closed to certain usage (including the use or possession of alcoholic beverages) for such period of time as may be determined by the Fair Board and/or its authorized representatives.

c. No person or vehicle shall be within the Fairgrounds except when the Fairgrounds or portion thereof is open, unless camping on a permit issued by the Ingham County Fair Board or its designated representatives.

ARTICLE II

CONDUCT ON FAIRGROUND PROPERTY

Section 2.1 PRESERVATION OF PROPERTY

No person shall disturb, destroy, deface, alter, change, or remove any part of the Fairgrounds land or any building, sign, structure, equipment, utility or any other property found herein.

Section 2.2 FIRE

No person shall build a fire within the Fairgrounds except in grills, or devices approved for such purpose by Ingham County Fair Board or its designated representatives.

Section 2.3 DISPOSAL OF REFUSE

No person shall:

a. Deposit or abandon in the Fairgrounds trash, waste, or other material,

except, in receptacles provided for such purposes.

b. Bring into the Fairgrounds refuse or litter originating outside the Fairgrounds for the purpose of depositing such in Fairgrounds or Fairgrounds receptacles.

Section 2.4 FIREWORKS, FIREARMS AND OTHER WEAPONS

No person shall:

a. Have in their possession or control any firearm, shotgun, pistol, rifle, slingshot, pellet gun, air rifle, fireworks or explosives within the Fairgrounds, unless approved by the Fair Board. This rule shall not apply to any law enforcement officer.

b. Have in their possession or control any bow and/or arrow within the Fairgrounds except by prior written permission of the Ingham County Fair Board.

Section 2.5 ALCOHOLIC BEVERAGES AND OTHER ILLEGAL SUBSTANCES

a. No person shall have in their possession any alcoholic beverages, except by written permission of the Ingham County Fair Board.

b. No person shall have in their possession, or use, an illegal substance on Fairground property.

Section 2.6 DISORDERLY CONDUCT

a. No person shall be a disorderly person within the Fairground boundaries. A person is a disorderly person if the person is any of the following:

1. A person who is intoxicated in a public place and who is either endangering directly the safety of another person or of property or is acting in a manner that causes a public disturbance.

2. A person who is engaged in indecent or obscene conduct in a public place.

b. No person shall interfere with any Fairground employee in the discharge of his or her duties, or fail or refuse to obey any lawful command issued by a Fairground employee.

Section 2.7 AUDIO DEVICES

No person shall play, use or operate any radio receiving set, television, musical instrument, phonograph or other machine or device for producing, reproducing or amplifying sound in such a manner as to create a noise disturbance. The use of such a machine or device such that the sound produced therefrom is audible in any direction at a distance in excess of 100 feet, shall be deemed excessive noise unless written permission has been obtained from the Ingham County Fair Board or their designated representatives.

ARTICLE III

DOGS AND PETS

Section 3

a. During non Fair events, dogs or other pets shall be kept on a leash no greater than 6 feet in length, under the immediate control of a responsible person and shall not be allowed to disturb or annoy Fairground visitors. The Ingham County Animal Control Ordinance and State Dog Law shall be strictly enforced.

b. During the annual Fair, no dogs or other pets shall be allowed outside of the owner's personal/business vehicle.

c. Leader dogs for the blind, hearing dogs for the deaf, and, service dogs for other handicapped individuals are permitted in all areas at all times.

d. The person that owns or is in immediate charge of any dog shall immediately remove all droppings and deposit in trash receptacle on Fairgrounds. If no receptacle is available, droppings are to be taken off Fairgrounds and disposed.

ARTICLE IV

MOTOR VEHICLES

Section 4.1

It shall be unlawful for any person to:

a. Operate a motor driven vehicle in excess of fifteen (15) miles per hour within the Fairgrounds, except where otherwise posted.

b. Operate a motor driven vehicle in violation of posted traffic control signs or devices.

Section 4.2

All motor driven vehicles operated on Fairground roadways or parking lots shall be subject to the laws of the State of Michigan as set forth in the Michigan Vehicle Code.

ARTICLE V

PARKING

Section 5.1 PARKING IN PROHIBITED AREAS

It shall be unlawful for any person to:

a. Park any motor vehicle within any area not designated as a parking area or space. Violations will result in a ticket and/or the vehicle being towed.

b. Stop, stand or park any motor vehicle at any place where official signs prohibit. Violations will result in a ticket and/or the vehicle being towed.

Section 5.2 OBSTRUCTING TRAFFIC

a. It shall be unlawful for the operator of any vehicle to stop, stand, or park such vehicle upon any roadway or on any parking area in such a manner as to form an obstruction to traffic.

b. Whenever any police officer finds a vehicle unattended upon a roadway or in a parking area and where such vehicle constitutes an obstruction to traffic, such officer is hereby authorized to provide for the removal of such vehicle to the nearest garage or other place of safety.

c. The necessary costs for such removal shall become a lien upon such vehicle and the person into whose custody the vehicle is given may retain it until all expenses involved have been paid.

ARTICLE VI

Section 6.1 COMMERCIAL ACTIVITIES AND ADVERTISING

a. No person or organization shall advertise, vend, sell, post or distribute any service, food, beverage, merchandise, or poster within the Fairgrounds except by prior written permit from the Ingham County Fair Board and their designated representatives.

b. To ensure the continued safety of the public at the Fairgrounds, solicitation of any form by any person or organization will be allowed in the following areas: 50 feet from all entrances or exits including all buildings, ticket booths, and rides.

c. Any electronic amplification device or shouting to relay a solicitation message is prohibited.

Section 6.2 PLACING HANDBILLS ON VEHICLES

No person shall place or cause to be placed in or on a vehicle, or in any manner fasten or attach to any vehicle, while such vehicle is in a Fairground parking lot, any placard, handbill or advertisement without first obtaining consent therefor from the owner thereof.

No person shall camp within Fairgrounds except in those areas or buildings designated for that purpose and provided that written permission of the Ingham County Fair Board or its designated representatives is acquired prior thereto.



ARTICLE VIII

FEES, CHARGES AND PERMITS

Section 8

a. It shall be unlawful for any person to use any facility, building, land area or equipment for which a fee or charge has been established by the Ingham County Fair Board without payment of such fee or charge.

b. It shall be unlawful for any person, group or organization to occupy or use any facility, building, land area or equipment for which a permit has been granted to another person, group or organization.

ARTICLE IX

ENFORCEMENT AND PENALTIES

Section 9

a. Any person violating any provision of the foregoing rules, except provision of the Motor Vehicle Code incorporated herein, shall be deemed guilty of a misdemeanor punishable by imprisonment for not more than ninety (90) days or work in a Fairground clean-up program as an alternative to the imprisonment, or a fine not more than five hundred dollars ($500.00) or both. Any person violating the provisions of the Motor Vehicle Code shall be subject to the fines and penalties set forth in that code.

b. Persons continuing to violate any of the above provisions after being warned of a violation of the Fairground Rules and Regulations may also be evicted from the fairground for the remainder of the day of the offense.

ARTICLE X

EFFECTIVE DATE

Section 10

These rules and regulations shall be effective after having been published once in a newspaper of general circulation in the County.
