RESOLUTION TO ADOPT AN AGREEMENT BETWEEN THE SHERIFF

OF INGHAM COUNTY, COUNTY OF INGHAM, AND THE

INGHAM COUNTY ROAD COMMISSION

RESOLUTION #98-23

WHEREAS, the Sheriff of Ingham County has agreed to deputize one Road Commission Officer as a Special Deputy Sheriff; and

WHEREAS, the Ingham County Road Commission has made this request of the Sheriff to enforce laws of the State of Michigan, enforce the provisions of the Ordinances of the County of Ingham, to serve warrants issued for violations of said laws and ordinances, and to make arrests of persons named in such warrants and to take them into custody; and

WHEREAS, the Ingham County Road Commission has agreed to provide liability insurance acceptable to both the Sheriff and Ingham County, and shall be procured by the Road Commission, insuring the Road Commission and any of its officers acting under the authority of this contract against liability arising out of any injury or death of any person or damage to any property caused by any act or omission of any Road Commission Officer; and

WHEREAS, the Special Deputy of the Ingham County Road Commission shall be considered strictly an employee of the Ingham County Road Commission, and the appointment as Special Deputy Sheriff for Ingham County shall not constitute an entitlement to any benefits due to employees of the County or employees of the Sheriff's Office.

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners approves the Agreement between the Sheriff of Ingham County, the Ingham County Road Commission and the County of Ingham.

BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners authorizes the Ingham County Board Chairperson and the Ingham County Clerk to sign such Agreement subject to approval as to form by the County Attorney.
