RESOLUTION AUTHORIZING THE ADVANCE OF FUNDS FROM THE CONTINGENCY FUND

FOR BRYNE GRANT MATCH FOR TWO ASSISTANT PROSECUTING ATTORNEY POSITIONS IN THE INGHAM COUNTY

PROSECUTING ATTORNEY'S OFFICE



RESOLUTION #98-58



WHEREAS, the Ingham County Prosecuting Attorney has two Assistant Prosecutors who are assigned to perform vertical prosecution in major drug conspiracy cases; and



WHEREAS, the funding for these attorneys has in the past been paid one half by monies from a Bryne Memorial Grant and the other half from the proceeds of forfeiture proceedings; and



WHEREAS, it appears that the monies available from forfeiture may not be sufficient to meet the match for the referenced positions for the year 1998; and



WHEREAS, it is consistent with the objectives of the Board of Commissioners to effectuate effective prosecution of those involved in major drug conspiracies; and



WHEREAS, the Ingham County Prosecuting Attorney's Office is requesting the Board of

Commissioners advance the sum of $61,932 for the period from April 1 through December 31, 1998 to be used if necessary for the match of the aforementioned referenced positions for the remainder of the year; and



WHEREAS, it is expected that the Metro Squad will reimburse Ingham County for this advance once sufficient forfeitures are processed and available for this purpose.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners hereby authorize the advance of up to $61,932 for the 1998 Prosecuting Attorney's budget to be used as match for two Assistant Prosecuting Attorney positions in the Bryne Memorial Grant subcontract.



BE IT FURTHER RESOLVED, that the Controller is authorized to make the necessary budgetary adjustments to the County and Prosecuting Attorney's 1998 budget in accordance with this resolution to continue the positions through December of 1998.

BE IT FURTHER RESOLVED, that these two APA grant positions will end December 31, 1998 unless:



1) The Tri-County Metro Squad has repaid the advance from forfeiture funds by December 31,

1998, or the Tri-County Metro Squad and Prosecutor have negotiated a reimbursement

schedule satisfactory to the Controller, and



2) The 1999 Ingham County Budget contains sufficient funds from the general fund, grants,

and/or drug forfeiture funds to continue these positions in 1999.
