RESOLUTION AUTHORIZING THE SALE OF CERTAIN REAL ESTATE IN THE CITY OF LANSING TO THE BOARD OF WATER AND LIGHT FOR CONSTRUCTION AND OPERATION OF A CHILLED WATER FACILITY



RESOLUTION #99-159



WHEREAS, the Board of Water and Light is planning to provide chilled water service to downtown Lansing; and



WHEREAS, if implemented, both the Grady Porter Building and the new consolidated courts facility could utilize this service to the County's advantage; and



WHEREAS, the Board of Water and Light needs to acquire property to build a centralized chilled water facility; and



WHEREAS, the Board of Water and Light is proposing an option to purchase the county-owned parking lot across the street from the Grady Porter Building; and



WHEREAS, the Board of Commissioners is willing to sell the property to the Board of Water and Light, provided that the parking spaces which would be lost can be relocated to the site of the consolidated courts building for the price paid; that the proposed appearance and operation of the structure to be built on the purchased property is acceptable to the Joint Building Authority; that the price received is also sufficient to pay for the expense of acquiring replacement parking during construction; that the service will be provided by the time needed for timely occupancy of the new consolidated courts building; and that the county can satisfactorily negotiate the cost of chilled water service.



THEREFORE BE IT RESOLVED, that the Board of Commissioners authorizes the sale of the subject property to the Board of Water and Light, provided that the parking spaces which would be lost can be relocated and maintained on the site of the consolidated courts building for the price paid; that the proposed appearance and operation of the structure to be built on the purchased property is acceptable to the Joint Building Authority; that the price received is also sufficient to pay for the expense of acquiring replacement parking during construction; that the service will be provided by the time needed for timely occupancy of the new consolidated courts building, and that the county can satisfactorily negotiate the cost of chilled water service.

BE IT FURTHER RESOLVED, that the Controller and County Attorney are authorized to negotiate terms of sale with the Board of Water and Light consistent with the conditions set forth in this resolution, and that the Chairperson of the County Board of Commissioners and the County Clerk are authorized to sign the necessary documents.
