OF DIRECTORS OF THE EDC AND SETTING HEARING DATE

RESOLUTION #99-190



Minutes of a regular meeting of the Board of Commissioners of the County of Ingham, Michigan, held at 7:30 o'clock p.m., Michigan Time, on Tuesday, August 24, 1999, at which time the following members were present:

Bernero, Czarnecki, Grebner, Juall, Minter, Pratt, Schafer, Schmidt, Severino,Smiley and Stid

and the following were absent: Lynch and McDonald

The following preamble and resolution were offered by Commissioner Juall and supported by Commissioner Schafer:



WHEREAS, there exists in the County of Ingham the need for projects to alleviate and prevent conditions of unemployment, to assist and retain local industrial and commercial enterprises in order to strengthen and revitalize the County's economy and to encourage the location and expansion of such enterprises to provide needed services and facilities to the County and its residents; and



WHEREAS, the Economic Development Corporations Act, Act No. 338 of the Michigan Public Acts of 1974, as amended (the "Act") provides a means for the encouragement of such projects in this County through the County's Economic Development Corporation (the "EDC"); and



WHEREAS, the EDC has commenced proceedings under the Act for the benefit of such a project at the request of Martin Luther Memorial Home, Inc. (the "Project"), and has designated to this Board of Commissioners a Project Area and Project District Area for its approval;



WHEREAS, this Board wishes to set a date for a public hearing on the Project Plan for the Project, to be prepared by the EDC, and on the issuance of bonds;



NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF INGHAM, as follows:



The Project Area, as described in the attached Exhibit A, as designated by the EDC to this Board is certified as approved.

It having been determined that the territory surrounding the designated Project Area will not be significantly affected by the Project because the surrounding territory is devoted to compatible uses, a Project District Area having the same description as and boundaries coterminous with the Project Area certified here as approved be established.

It having been determined that there are less than eighteen (18) residents, real property owners, or representatives of establishments located within the Project District Area, a Project Citizens District Council shall not be formed pursuant to Section 20(b) of the Act.

The appointments of __Richard Bacon and _Kenneth O'Hara, who are representative of neighborhood residents and business interests likely to be affected by the Project, to the Board of Directors of the EDC are confirmed in accordance with Section 4(2) of the Act. Richard Bacon and Kenneth O'Hara shall cease to serve when the Project for which they are appointed is either abandoned or, if undertaken, is completed in accordance with the Project Plan.

A public hearing upon the proposed Project Plan for the Project and the issuance of bonds in an amount not to exceed $33,000,000 to finance the Project and other improvements, and refinance debt previously issued by the EDC on behalf of Martin Luther Memorial Home, Inc. shall be held at 7:30 o'clock p.m., Michigan time, on the 21st day of September, 1999

The County Clerk is directed to give notice of the public hearing by (1) publishing a notice of the hearing in a newspaper of general circulation in the County on or before September 7, 1999; (2) posting in at least ten (10) public and conspicuous places in the project district area; and (3) mailing to the last known owner of each parcel of real property in the project district area at the last known address of the owner as shown by the tax assessment records, the posting and mailed notices shall be given no later than September 7, 1999. The notice shall be substantially in the form attached as Exhibit B.

The County Clerk is directed to provide three (3) certified copies of this resolution to the Secretary of the EDC.

All resolutions or parts thereof in conflict with this resolution are repealed, but only to the extent of the conflict.

MARTIN LUTHER MEMORIAL HOME PROJECT





The project area is on the site of the Martin Luther Memorial Home, 5091 Willoughby Road, Holt, Michigan. The legal description of the site is as follows:



A parcel located in the Township of Delhi, County of Ingham, State of Michigan further described as follows: the West 16 acres of the Northeast 1/4 of Northeast 1/4 of Section 16, T3N, R2W, Delhi Township. Ingham County, Michigan, described as: Beginning at a point on the North line of said Section 16, 808.35 feet West of the Northeast corner of said Section 16; thence West along said North line of Section 16, 528 feet; thence South parallel to the East line of Section 16, 1320 feet; thence East parallel to the North line of Section 16, 528 feet; thence North parallel to the East line of Section 16, 1320 feet to the point of beginning; together with a parcel described as: Commencing at the Northeast corner of said Section 16; thence West along the North line of Section 16, 776.00 feet to the point of beginning; thence South 00 degrees 17 minutes 21 seconds East parallel to the East line of Section 16, 592.50 feet; thence West parallel to the North line of Section 16, 31.55 feet; thence North 00 degrees 21 minutes 43 seconds West 592.50 feet to the North line of Section 16; thence East along the North line of Section 16, 32.30 feet to the point of beginning.
