RESOLUTION AUTHORIZING THE PROSECUTOR'S OFFICE TO RAISE SERVICE FEES FOR DIVERSION PARTICIPANTS

RESOLUTION #99-62

WHEREAS, the Ingham County Prosecutor's Office has charged participants of Diversion a service fee for participating in the Diversion program since the inception of said program; and

WHEREAS, there have been major changes in Michigan statutes, that have increased the felony threshold; and the Prosecutor wishes to update the service fees to compliment the maximum penalty changes in certain State of Michigan's criminal laws that were effective, January 1, 1999; and

WHEREAS, the Ingham County Prosecuting Attorney wishes to increase the service fee for applicable charges. The increase in service fees would not necessarily increase revenues due to the number of felonies that were downgraded to misdemeanors; and

WHEREAS, the Ingham County Board of Commissioners approves the service fees for the Diversion Program based on the recommendations from the Prosecuting Attorney.

THEREFORE BE IT RESOLVED, that the following service fees for Diversion established below are adopted for immediate implementation:

93 Day Misdemeanors $200.00

One Year Misdemeanors $400.00

5 Year Felonies $600.00
