RESOLUTION TO AUTHORIZE A CONTRACT WITH THE MICHIGAN DEPARTMENT OF COMMUNITY HEALTH TO IMPLEMENT A REGIONAL INSPECTION PROGRAM OF TOBACCO RETAILERS





RESOLUTION #99-80



WHEREAS, the Michigan Department of Community Health (MDCH) has a contract with the US Food and Drug Administration to monitor sales of tobacco to people under the age of 18 years in the State of Michigan; and



WHEREAS, the MDCH proposes to implement the monitoring of activity by contracting with local agencies to implement monitoring in a geographic region; and



WHEREAS, the MDCH has proposed a Mid-Michigan Region (Area 4) which includes Shiawassee, Barry, Eaton, Clinton, Gratiot, Montcalm, Midland, Saginaw, Livingston and Ingham Counties; and



WHEREAS, the public health agencies in the several counties have identified the Ingham County Health Department as the best choice for a lead agency in the Region; and



WHEREAS, staff from the Ingham County Health Department have worked with the public health agencies in the several counties to identify a general approach to the monitoring activity; and



WHEREAS, the proposed model would be to employ an adult investigator to accompany youths who will be recruited and trained to conduct 750 compliance visits at the estimated 1788 tobacco retailers in the Region; and



WHEREAS, the Health Officer has recommended that the Board of Commissioners authorize the proposed agreement.



THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorizes an agreement with the Michigan Department of Community Health to conduct an inspection program of tobacco retailers in a region comprised of Clinton, Eaton, Gratiot, Ingham, Livingston, Midland, Montcalm, Saginaw and Shiawassee Counties.



BE IT FURTHER RESOLVED, that the period of the agreement will be November 30, 1998 through September 30, 1999 and that the State will provide Ingham County with up to $64,431 of federal funds to implement the program.



BE IT FURTHER RESOLVED, that subcontracts with public or private agencies or organizations in the other nine counties in the Region are authorized, with the contracting agencies to be compensated at the rate of $75 per compliance check completed.

RESOLUTION #98-80



BE IT FURTHER RESOLVED, that the Chairperson of the Board is authorized to sign contracts with the counties where the services will be provided, as required by state statute.



BE IT FURTHER RESOLVED, that the classification for position HLHEDC011 shall be changed from Assist Program Specialist (ICEA P2) to Health Educator II (ICEA P5) effective April 1, 1999.



BE IT FURTHER RESOLVED, that the Controller is authorized to amend the Health Department's 1999 budget to implement the resolution.



BE IT FURTHER RESOLVED, that the Board Chairperson is authorized to sign the agreement and the subcontracts after review by the County Attorney.
